End User License Agreement and Terms of Use

This End User License Agreement and Terms of Use (“Agreement”) governs your access to and use of the Golden Years IT chatbot service known as Golden Tech Helper (the “Service”).

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Service.

1. Description of the Service

Golden Years IT provides Golden Tech Helper, an AI-powered chatbot designed to provide general guidance related to:

  • technology usage

  • device troubleshooting

  • digital safety

  • scam awareness

The Service provides automated informational assistance and step-by-step guidance. It does not replace professional technical support or professional advice.

2. AI-Generated Responses

The Service uses artificial intelligence to generate responses.

AI-generated information may be incomplete, inaccurate, or outdated. Responses are provided for informational purposes only and should not be relied upon as the sole basis for technical decisions.

Golden Years IT does not guarantee that information provided by the Service will resolve technical problems, prevent scams, or eliminate security risks.

Users should independently verify important information before taking action.

3. AI-Generated Images and Visual Guides

The Service may provide screenshots, diagrams, or visual guides to assist users with technology instructions. Some images may be generated using artificial intelligence services provided by third-party providers, including OpenAI.

These images are provided for illustrative and instructional purposes only and may not exactly match the appearance of a user’s device, operating system, software version, or settings. Users should not rely solely on AI-generated images for critical actions.

Users are responsible for confirming that instructions and images correspond to their specific device or software before making changes.

Golden Years IT does not control third-party AI services and is not responsible for interruptions, errors, or changes in functionality, availability, or content produced by these services.

Golden Years IT is not responsible for actions taken based on visual guidance that differs from a user’s actual system configuration.

4. No Professional Advice

The Service does not provide professional advice of any kind.

Golden Years IT is not acting as a licensed technician, attorney, financial advisor, cybersecurity professional, or other regulated professional.

Any actions you take based on information provided by the Service are taken at your own discretion and risk. When appropriate, you should consult a qualified professional.

5. User Responsibility

You acknowledge and agree that you are solely responsible for:

  • verifying the accuracy and applicability of information provided by the Service

  • implementing any guidance at your own risk

  • maintaining backups of your data

  • protecting your devices, accounts, and personal information

Golden Years IT does not have access to your devices, software configurations, or personal accounts and cannot account for all technical environments or device conditions.

6. Fees and Payments

Certain features of the Service may require payment, including:

  • subscription memberships

  • one-time support or troubleshooting sessions

Payments are processed securely through third-party payment providers such as Stripe or PayPal.

Golden Years IT does not store or process full payment card information. Payment processing is governed by the terms and privacy policies of the applicable payment provider.

7. Acceptable Use

You agree to use the Service only for lawful, personal, and non-commercial purposes.

You agree not to:

  • use the Service for fraudulent, deceptive, or illegal activity

  • attempt to reverse engineer, copy, or modify the Service

Golden Years IT reserves the right to suspend or terminate access to the Service if these terms are violated.

8. Sensitive Information

Users should not submit sensitive personal information through the Service, including but not limited to:

  • credit card numbers

  • financial account information

  • government identification numbers

  • medical information

  • private account credentials

Golden Years IT is not responsible for protecting sensitive information voluntarily shared in chatbot conversations.

9. Privacy and Data Processing

Use of the Service is also governed by the Golden Years IT Privacy Policy, which explains how information is collected, used, and protected.

Chat conversations may be stored by Golden Years IT in order to:

  • provide support

  • improve the Service

  • maintain system functionality

Some messages may be processed by third-party artificial intelligence providers, including OpenAI, to generate responses and maintain system safety. These providers may temporarily process certain data in accordance with their own policies.

10. Intellectual Property

The Service, including all software, text, graphics, design, features, and functionality, is the property of Golden Years IT and is protected by intellectual property laws.

Golden Years IT grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal and non-commercial purposes.

You may not reproduce, distribute, modify, or create derivative works based on the Service without prior written permission.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN YEARS IT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • ACCURACY OR RELIABILITY

  • NON-INFRINGEMENT

Golden Years IT does not guarantee that the Service will be uninterrupted, error-free, secure, or free from technical issues.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN YEARS IT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE.

This includes, but is not limited to:

  • device or hardware damage

  • data loss or corruption

  • software misconfiguration

  • security incidents or missed scam indicators

  • loss of use, profits, or business interruption

IN NO EVENT SHALL THE TOTAL LIABILITY OF GOLDEN YEARS IT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESS TO THE SERVICE.

13. Termination

Golden Years IT reserves the right to suspend or terminate access to the Service at any time if:

  • this Agreement is violated

  • the Service is used in a harmful or unlawful manner

  • continued access poses a risk to the platform or other users

Users may discontinue use of the Service at any time.

14. Eligibility

You must be at least 18 years of age to use the Service.

By using the Service, you represent and warrant that you meet this requirement.

15. Modifications to Terms

Golden Years IT may update or modify this Agreement from time to time.

Updated terms will become effective upon posting on the website or within the Service. Continued use of the Service after updates constitutes acceptance of the revised terms.

16. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to this Agreement or the use of the Service shall be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court.

Arbitration shall be conducted by a neutral arbitrator in accordance with the rules of a recognized arbitration organization within the United States.

Each party will bear its own legal fees unless otherwise required by law.

17. Class Action Waiver

You agree that any dispute or claim related to the Service must be brought individually and not as part of a class action, collective action, or representative proceeding.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Golden Years IT.

18. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

19. Entire Agreement

This Agreement constitutes the entire agreement between you and Golden Years IT regarding the Service and supersedes all prior or contemporaneous agreements, communications, or understandings.
